Mesothelioma Cancer Law and You

Tens of thousands of people contracted mesothelioma after exposure to asbestos. This fatal cancer can take up to 50 years before it is detected. Since the early 20th century, millions of dollars worth of lawsuits were won in American courts. Because of the rising number of victims as well as the reckless endangerment of human lives by large asbestos companies, mesothelioma cancer law is subject to change and under review at this time.


Ban on the Use of Asbestos Products


Proposals to ban asbestos in the United States were announced on June 18, 2002.
The bill had four parts:


A national ban on asbestos must be in place by 2005.


Public Awareness about asbestos products including which products are in use in the US by way of foreign trade.


Research into asbestos diseases should be funded by the Federal Government. Seven regional mesothelioma treatment centers are to be established. A national Mesothelioma Registry will be set up.


The scope of the Blue Ribbon Panel on Asbestos will be expanded to facilitate review of "the health effects of exposure to asbestos, the accuracy of the definition of asbestos-containing material and modern procedures for the disposal of asbestos-containing products. Research on a uniform asbestos standard for federal agencies and a protocol for detecting and measuring asbestos will be undertaken. The Panel has two years to make its recommendations."


Legal Rights for Victims of Mesothelioma

Proof of Asbestos Exposure


In order to establish a claim (against manufacturers, distributors, and/or contractors) it must be established that you had been exposed to the specific asbestos product at a specific location. In order to file a claim the employer and location must be readily definable.


Compensation will be determined by factors such as lost income, state laws, and the parties responsible. Compensation for Mesothelioma can vary from several hundred thousand to several million.
